DMCA Policy

Vixie.art respects the intellectual property rights of others and expects users of our Service to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement reported to our designated copyright agent.
Your Responsibilities as a User
By using Vixie.art, you represent and warrant that:
- You own or have the necessary rights, licenses, consents, and permissions to upload and use any images you submit to the Service.
- You will not upload images that infringe the copyright, trademark, privacy, publicity, or other rights of any third party.
- You understand that uploading images you do not have rights to may expose you to legal liability.
Reporting Copyright Infringement
If you believe that content available on or through Vixie.art infringes one or more of your copyrights, please send a written notice ("DMCA Notice") containing the following information to our designated copyright agent:
- Identification of the copyrighted work — A description of the copyrighted work you claim has been infringed, or if multiple works are covered by a single notice, a representative list of such works.
- Identification of the infringing material — A description of the material you claim is infringing and information reasonably sufficient to permit us to locate it (e.g., a URL or other specific identifier).
- Your contact information — Your name, mailing address, telephone number, and email address.
- A statement of good faith — A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- A statement of accuracy — A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorised to act on behalf of the copyright owner.
- Your signature — A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.
We will review all valid DMCA Notices and respond in accordance with applicable law, which may include removing or disabling access to the allegedly infringing content.
Counter-Notification
If you believe your content was removed as a result of a mistake or misidentification, you may submit a counter-notification to dmca@vixie.art with the following information:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court in your district (or if outside the United States, any judicial district in which Vixie.art may be found), and that you will accept service of process from the person who provided the original DMCA Notice or their agent.
Repeat Infringer Policy
In accordance with the DMCA and other applicable law, Vixie.art has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. Vixie.art may also, at its sole discretion, limit access to the Service or terminate the accounts of users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.
